Can consumers seek compensation for faulty online purchased medical devices?

Medical devices, such as blood pressure monitors, glucose meters, hearing aids, and CPAP machines, are critical to health and well-being. When purchasing these devices online, consumers expect high standards of quality and safety. However, in cases where consumers receive faulty, counterfeit, or substandard medical devices, it can lead to significant health risks and financial loss. Fortunately, consumer protection laws such as the Consumer Protection Act, 2019 provide avenues for consumers to seek compensation for faulty products, including medical devices.

Legal Provisions for Seeking Compensation

Consumer Protection Act, 2019 (CPA)

The Consumer Protection Act, 2019 provides consumers with several rights and remedies when they are sold defective products, including medical devices. The act ensures that consumers can claim compensation for defective medical devices that cause harm or loss.

Complaints to Regulatory Bodies

  • Central Drugs Standard Control Organization (CDSCO): If the device is found to be defective or counterfeit, it can be reported to the CDSCO, which is responsible for the approval and regulation of medical devices in India.
  • Bureau of Indian Standards (BIS): For medical devices certified under BIS, complaints can be filed regarding substandard products.

Steps to Seek Compensation for Faulty Medical Devices

Contact the Seller or Manufacturer

  • Step 1: If you receive a faulty medical device, the first step is to contact the seller or manufacturer immediately. Most online platforms, like Amazon or Flipkart, have clear policies for returning or exchanging defective items.
  • Step 2: Request a refund or replacement based on the seller’s return policy, and document all communication for future reference.

Report the Issue to the E-Commerce Platform

  • Step 1: If the seller is uncooperative or refuses to provide a refund, file a complaint directly with the e-commerce platform. Most platforms allow consumers to report faulty products and mediate the dispute.
  • Step 2: Provide proof of the faulty product, including photos, videos, and medical reports (if applicable).

File a Complaint with Consumer Forums

If the issue is not resolved by the platform or seller, consumers can file a complaint with a consumer forum:

  • District Consumer Forum: For claims up to ₹20 lakhs.
  • State Consumer Forum: For claims above ₹20 lakhs but below ₹1 crore.
  • National Consumer Disputes Redressal Commission (NCDRC): For claims above ₹1 crore.

Report the Faulty Device to Regulatory Bodies

  • CDSCO: If the medical device is unsafe or violates regulatory standards, file a complaint with the Central Drugs Standard Control Organization (CDSCO).
