Can a consumer approach consumer courts for faulty telecom services?

Answer By law4u team

Telecom services, which include mobile networks, internet connectivity, and customer support, are essential for modern communication. However, consumers often face issues like network disruptions, unexplained charges, billing discrepancies, poor service quality, and delays in complaint resolution. Under the Consumer Protection Act, 2019, consumers have the right to approach consumer courts or consumer forums for redressal if they encounter faulty telecom services. They can seek remedies such as refunds, compensation for inconvenience, and even improvements in service quality.

Steps to File Complaints for Faulty Telecom Services:

  1. Resolve the Issue with the Telecom Service Provider
    • Contact Customer Support: The first step is to contact the telecom provider's customer service to report the issue. This may include:
      • Network issues (e.g., poor signal strength, dropped calls).
      • Billing errors (e.g., overcharging, incorrect charges).
      • Slow or inconsistent internet speeds.
      • Unresolved complaints or poor service.
    • Request Resolution: Ask for an explanation and resolution of the issue. This may involve:
      • Network repairs.
      • Refund for incorrect billing.
      • Reimbursement for downtime (e.g., if the internet or mobile network was down for a significant period).
    • Timeframe for Resolution: Telecom providers typically have 14-30 days to address and resolve consumer complaints.
  2. Escalate the Complaint to Senior Management
    • If the issue remains unresolved, ask for the matter to be escalated to a supervisor or senior management for further review.
    • Document Everything: Keep records of all communications, including:
      • Emails or letters.
      • Complaint reference numbers.
      • Details of phone calls (dates, times, and issues discussed).
  3. File a Complaint with the Consumer Forum
    • If the telecom provider fails to resolve the issue satisfactorily or delays resolution, consumers can file a complaint with the consumer forum under the Consumer Protection Act, 2019.
    • Jurisdiction: Depending on the monetary value of the claim, you can file the complaint in the appropriate forum:
      • District Consumer Forum: Claims up to ₹1 crore.
      • State Consumer Commission: Claims between ₹1 crore and ₹10 crore.
      • National Consumer Commission: Claims exceeding ₹10 crore.
    • Documents to Submit: When filing a complaint, include:
      • A detailed complaint letter outlining the issue.
      • Proof of purchase or service contract.
      • Communication records (emails, call logs, chat transcripts).
      • Proof of billing discrepancies or service failures.
      • Service agreements or warranty documents, if applicable.
  4. Approach the Telecom Regulatory Authority of India (TRAI)
    • TRAI is the national regulator for the telecom industry in India. If a consumer is facing persistent issues such as:
      • Billing disputes.
      • Service quality problems.
      • Unresolved complaints.
      • False advertising.
    • File a Complaint with TRAI: You can file a complaint with TRAI’s Consumer Complaints Portal. TRAI can intervene and direct the telecom provider to address the issue.
  5. Filing Complaints through the National Consumer Helpline (NCH)
    • The National Consumer Helpline provides an easy and accessible way for consumers to lodge complaints. The NCH serves as an intermediary and helps facilitate resolutions for telecom service-related issues.
    • Consumers can file complaints online or via the helpline number.
  6. Consumer Court (District/State/National)
    • If the issue persists despite trying all other methods, you can approach the consumer court directly.
    • Legal Action: In case of significant financial losses, mental distress, or persistent service failures, consumers can seek compensation for the inconvenience caused.

Possible Compensation and Remedies:

  1. Refund for Billing Errors
    • If there are incorrect charges or billing mistakes by the telecom provider, the consumer can request:
      • Refunds for overcharges or erroneous billing.
      • Adjustment of the incorrect charges in future bills.
  2. Compensation for Service Failures
    • If a consumer faces issues like:
      • Network outages.
      • Continuous dropped calls or poor internet connectivity.
      • Unavailability of services.
    • The consumer forum may order the telecom provider to pay compensation for the inconvenience or mental distress caused by these service failures.
  3. Compensation for Harassment
    • In cases where the consumer has faced harassment due to poor customer support or unresolved complaints, the consumer forum may award compensation for emotional distress and harassment.
  4. Service Improvements
    • In certain cases, the consumer court may order the telecom provider to:
      • Improve the quality of their services.
      • Provide timely support for future complaints.

Example:

A consumer in Mumbai experiences repeated network issues with their telecom provider, which affects both mobile calls and internet services. Despite several complaints to customer support, the issue remains unresolved. The consumer is also charged for services that were not rendered due to network downtime.

Steps the Consumer Should Take:

  • Contact Customer Service: Report the network issue and ask for compensation or a service adjustment.
  • Escalate the Issue: If the customer service team does not resolve the issue, ask to escalate the matter to a supervisor or senior representative.
  • File a Complaint with TRAI: If there is no resolution, file a complaint with TRAI to investigate the poor service quality and incorrect billing.
  • File a Complaint with the Consumer Forum: If the issue remains unresolved, file a formal complaint in the District Consumer Forum for compensation for the inconvenience caused by the faulty service.

Consumer Safety Tips:

  • Know Your Rights: Familiarize yourself with the telecom regulations under the Consumer Protection Act, 2019, and TRAI guidelines.
  • Document Complaints: Keep a record of all communications, including emails, call logs, and complaint reference numbers. This will be crucial if you need to escalate the issue.
  • Be Persistent: If the issue isn't resolved by customer service, don't hesitate to escalate it to senior management, TRAI, or a consumer forum.
  • Verify Billing: Regularly check your telecom bills to ensure you are not being overcharged for services or plans you did not use.
