What penalties can be imposed for unfair trade practices?

Under the Consumer Protection Act 2019, unfair trade practices are defined as actions or behavior that deceive, mislead, or cause harm to consumers. These practices can include false advertising, misleading claims, fake products, and fraudulent business conduct. To protect consumers, the law provides for penalties to discourage such behavior and ensure that businesses adhere to fair practices. Penalties for Unfair Trade Practices under the Consumer Protection Act 2019

1. Monetary Penalty

Fine for False Advertising or Misleading Claims:

  • If a business is found guilty of engaging in unfair trade practices, such as false advertising or misleading claims, the consumer forum can impose a penalty. The penalty can range from ₹10,000 to ₹50,000 for the first violation.
  • If the business repeats the offense, the fine can go up to ₹1 lakh.
  • For subsequent violations, the fine may increase to ₹10 lakh or more, depending on the severity of the unfair practice.
  • Penalty for Non-Compliance with Directions: If a business does not comply with a direction or order issued by the consumer forum or the Central Consumer Protection Authority (CCPA), it can face a fine of up to ₹1 lakh.
  • If the violation continues, the penalty can be increased, and the business can also face further legal actions.

2. Imprisonment

In more severe cases of unfair trade practices, such as deliberate fraud or harmful consumer exploitation, imprisonment can also be imposed.

  • Imprisonment for False or Misleading Advertising: If the violation involves deceptive advertising or the sale of counterfeit goods, the guilty party can face imprisonment for up to 1 year for the first offense.
  • In cases of repeat offenses, the imprisonment can extend to up to 3 years along with a fine.

3. Compensation for Affected Consumers

Consumers who have been affected by unfair trade practices are entitled to compensation. This compensation can be awarded by the consumer forum based on the consumer's loss, inconvenience, or harm caused by the unfair practice.

  • For example, if a consumer has purchased a counterfeit product or has been misled by false advertising, the forum can order the seller to refund the amount paid for the product, along with compensation for any harm or inconvenience caused.
  • The compensation may also include the cost of litigation, travel, and other associated expenses.

4. Consumer Redressal Mechanism

In addition to monetary penalties and imprisonment, the Consumer Protection Act mandates that businesses caught engaging in unfair trade practices must also take corrective actions.

  • These actions could include:
    • Removal of deceptive advertisements.
    • Destruction or recall of defective products.
    • Withdrawal of misleading claims from the market.
  • The Central Consumer Protection Authority (CCPA) has the authority to issue orders to businesses or service providers to cease unfair practices and offer redress to affected consumers.

5. Suspension of Business License

In extreme cases, where the unfair trade practices are part of a systemic or fraudulent business model, the government or the Consumer Protection Authority can recommend the suspension or revocation of the business's license.

  • This is especially relevant for businesses involved in the sale of counterfeit goods, fake services, or widespread fraud.

Types of Unfair Trade Practices and Corresponding Penalties

1. False or Misleading Advertising

Example: A company claims its product can cure a disease without any scientific evidence.

  • Penalty: A fine of ₹10,000 to ₹50,000 for the first offense, with potential imprisonment for repeated offenses.

2. Sale of Counterfeit or Substandard Goods

Example: A retailer sells fake smartphones that do not meet quality standards.

  • Penalty: A fine of up to ₹1 lakh for the first violation, and imprisonment for repeat violations.

3. Fake Claims about Products or Services

Example: A service provider falsely claims that their product has certain certifications or guarantees that it doesn’t.

  • Penalty: Refund to consumers, compensation for inconvenience, and a fine.

4. Bait-and-Switch Advertising

Example: A business advertises a product at a low price but then refuses to sell it, offering a more expensive alternative instead.

  • Penalty: Refund to the consumer, monetary fine, and potential imprisonment.

Example of Penalties for Unfair Trade Practices

Case Example: A consumer purchased a health supplement online after seeing an advertisement that claimed it could help in rapid weight loss. The ad was misleading and did not mention potential side effects or lack of scientific evidence. After the consumer filed a complaint with the consumer forum:

  • The business was found guilty of false advertising.
  • The consumer forum imposed a fine of ₹50,000 on the company for misleading advertisements.
  • The forum ordered the company to refund the consumer’s money and pay ₹25,000 as compensation for the inconvenience caused.
  • The company was also directed to remove all misleading ads from their platforms and issue a public disclaimer regarding the false claims.
