Types of Defects Covered Under the Consumer Protection Act

Manufacturing Defect

  • Occurs when a product deviates from its intended design during production.
  • Example: A smartphone battery catching fire due to poor assembly.

Design Defect

  • Flaws inherent in the product design that make it unsafe or unsuitable for use.
  • Example: A toy with small detachable parts that pose a choking hazard.

Labeling Defect

  • Incorrect, misleading, or missing information on product packaging or labels.
  • Example: A food product claiming sugar-free but containing sugar.

Service Deficiency (Deficient Service)

  • Services that fail to meet promised standards or are incomplete, substandard, or unsafe.
  • Example: A hospital misdiagnosing a patient or an internet service provider failing to deliver promised speeds.

Adulteration or Substandard Goods

  • Goods that do not meet prescribed quality or safety standards.
  • Example: Medicines with incorrect dosages or expired products being sold.

Unfair Trade Practices

  • Practices that deceive, mislead, or exploit consumers.
  • Example: False advertising, hidden charges, or selling counterfeit products.

Unsafe Products

  • Products that pose a threat to life, health, or property due to poor quality or harmful materials.
  • Example: Electrical appliances without proper insulation causing electric shocks.

Consumer Actions for Defective Goods or Services

Document Evidence

  • Bills, warranty cards, receipts, photographs, service agreements, and communication with the seller/service provider.

Contact the Seller/Service Provider

  • Give a written notice requesting repair, replacement, or refund.

File a Complaint

  • File in District Consumer Forum, State Consumer Commission, or National Consumer Commission depending on the claim amount.
  • Use the e-Daakhil portal for online filing.

Seek Legal Remedies

  • Compensation for loss or injury, replacement of goods, refund, or corrective action in services.

Suppose a consumer purchases a washing machine that starts leaking water within two months, despite proper usage.

Steps to Take

  • Identify the defect type – this is a manufacturing defect.
  • Contact the seller/service provider for repair or replacement.
  • If unresolved, file a complaint in the District Consumer Forum.
  • Submit evidence: purchase bill, warranty card, and photos of the leakage.
  • The forum may order the manufacturer to replace the washing machine or provide a full refund.
  • If dissatisfied, appeal to the State Consumer Commission.
