भारतीय कानून के तहत, माता-पिता के जीवित रहते हुए उनकी संपत्ति का बटवारा करने का अधिकार बच्चों को नहीं होता है। माता-पिता की संपत्ति उनकी अपनी आपत्ति के अनुसार बांटी जाती है और यह उनके विवाहित और अविवाहित बच्चों तक पहुंचती है। यदि माता-पिता को कोई आपत्ति नहीं है और वे अपनी संपत्ति का बटवारा नहीं करना चाहते हैं, तो वे उसे अपनी इच्छा के अनुसार बनाए रख सकते हैं। हालांकि, यदि बच्चे को अपने माता-पिता की संपत्ति के बारे में कोई विवाद होता है या वे अनुचित तरीके से उसका उपयोग कर रहे हैं, तो वे न्यायालय के माध्यम से इस समस्या को हल करने की मांग कर सकते हैं। न्यायिक प्रक्रिया के तहत, वे अपने माता-पिता के खिलाफ मामला दायर कर सकते हैं और न्यायिक अधिकारी उसे विचार करेंगे।
