नहीं, कोई मित्र या असंबंधित व्यक्ति भारतीय कानून के तहत उत्तराधिकार प्रमाणपत्र के लिए आवेदन नहीं कर सकता है, जब तक कि उनके पास कोई कानूनी हित न हो या उन्हें किसी कानूनी उत्तराधिकारी द्वारा अधिकृत न किया गया हो। भारतीय उत्तराधिकार अधिनियम, 1925 के तहत: - उत्तराधिकार प्रमाणपत्र के लिए कोई व्यक्ति आवेदन कर सकता है जो मृतक का कानूनी उत्तराधिकारी हो (जैसे कि पति/पत्नी, बच्चे या माता-पिता)। - यह आमतौर पर जिला न्यायालय द्वारा धारक को मृतक के ऋण और प्रतिभूतियों को इकट्ठा करने के लिए अधिकृत करने के लिए जारी किया जाता है। अपवाद: कोई मित्र या असंबंधित व्यक्ति आवेदन कर सकता है यदि: - उनके पास किसी कानूनी उत्तराधिकारी से वैध पावर ऑफ अटॉर्नी (पीओए) हो, या - वे वसीयत या प्रोबेट के तहत न्यायालय द्वारा नियुक्त अभिभावक या निष्पादक हों अन्यथा, न्यायालयों को संपत्ति में प्रत्यक्ष कानूनी संबंध या हित की आवश्यकता होती है।
