What are the powers of Consumer Forums during hearings?

Answer By law4u team

Consumer Forums, established under the Consumer Protection Act, 2019, are judicial bodies created to resolve disputes between consumers and service providers or sellers. These forums aim to safeguard consumer rights by providing quick and accessible justice. Consumer forums hold significant powers during hearings, enabling them to pass orders, investigate cases, award compensation, and enforce consumer rights. These powers ensure that consumers have a fair chance of securing justice.

Powers of Consumer Forums During Hearings

1. Jurisdictional Powers

Consumer forums have the authority to hear and resolve consumer disputes based on their jurisdiction. Depending on the value of the dispute, the forum will determine the level at which the case will be heard:

  • District Consumer Forum: For disputes where the compensation or value of goods and services is less than ₹1 crore.
  • State Consumer Commission: For disputes with claims above ₹1 crore but less than ₹10 crore.
  • National Consumer Disputes Redressal Commission (NCDRC): For disputes involving claims exceeding ₹10 crore.

Each forum is empowered to pass binding orders within its jurisdiction, and its powers extend across both private and public sector services.

2. Passing Binding Orders

One of the most significant powers of the Consumer Forum is its ability to pass binding orders that compel the parties involved (usually businesses, service providers, or sellers) to:

  • Refund money: If the consumer has been overcharged or the product/service is defective.
  • Replace defective goods: If the product or service provided does not meet the agreed terms.
  • Pay compensation: If the consumer has suffered harm, loss, or inconvenience due to faulty products or services.
  • Apologize: In cases of unfair treatment or deceptive business practices, forums can order the business to publicly apologize.

3. Conducting Investigations

Consumer forums have the power to conduct investigations into allegations of unfair trade practices, false advertising, or defective goods/services. During the hearing process:

  • The forum may request further evidence or clarification from the consumer or the opposite party.
  • The forum can summon documents, inspect the goods or services involved, and order expert opinions if needed.
  • In certain cases, they can appoint investigators to probe more deeply into the matter.

4. Issuing Injunctions and Restraining Orders

Consumer forums can issue injunctions (a form of legal order to stop certain actions) against businesses or individuals engaged in unfair trade practices, misleading advertisements, or activities that harm consumer interests. Some examples include:

  • Restraining orders to stop the sale of defective products.
  • Injunctions to prevent the continuation of fraudulent activities or deceptive marketing practices.
  • Cease and desist orders to halt actions that violate consumer rights.

5. Awarding Compensation and Costs

Consumer forums are authorized to award compensation to consumers who have suffered losses due to defective goods, poor services, or malpractice. This can include:

  • Monetary compensation for damages, pain, and suffering, loss of income, or medical expenses.
  • Punitive damages in cases of gross negligence or severe consumer harm.
  • Refund of the purchase price or replacement of faulty goods.

In addition, the forum can order the defendant to pay the consumer's legal costs and any other related expenses.

6. Enforcing Orders and Compliance

Once a forum passes a judgment, it has the power to enforce compliance with its orders:

  • Warrants: If a party fails to comply with a consumer forum’s order, the forum may issue a warrant of execution to compel compliance.
  • Penalty for non-compliance: The consumer forum may impose fines or other penalties if the ordered compensation or action is not carried out within a stipulated time.
  • Involvement of the police: In cases where the party refuses to comply, the forum may also involve law enforcement agencies to ensure that the order is executed.

7. Summoning and Examining Witnesses

During hearings, consumer forums have the power to summon witnesses, examine evidence, and allow both parties (consumer and service provider) to present their cases:

  • Issuing summons: The forum can issue summons to any person to appear before it and testify, provide documents, or answer questions.
  • Witness examination: The forum can examine both parties and their witnesses under oath to establish facts.
  • Expert evidence: In complex cases (such as medical negligence or product defects), the forum can seek expert opinions to help in making informed decisions.

8. Settlement and Mediation

While Consumer Forums have full judicial powers, they also encourage amicable settlement. If both parties agree, the forum can facilitate mediation to resolve the dispute without a formal hearing. Mediation is a less formal, quicker method, where both parties work towards a mutually agreeable resolution with the help of a neutral mediator.

9. Reviewing and Setting Aside Decisions

Consumer forums also have the authority to review or modify their decisions if new evidence emerges or if there is a procedural flaw in the initial judgment. If a party believes that the decision was unjust, they can file an appeal with a higher forum:

  • Appeal to the State or National Commission: If the consumer or defendant is unsatisfied with the decision of the district-level forum, they can appeal to the State Commission or National Commission.

Example: Powers of Consumer Forum in Action

Scenario:

A consumer buys an electronic gadget that turns out to be defective. Despite multiple repair attempts, the issue persists. The consumer files a complaint with the District Consumer Forum.

Actions Taken by the Consumer Forum:

  • Summoning of the company’s representatives: The forum summons the seller/manufacturer to explain why the defective product has not been replaced.
  • Issuing an injunction: The forum orders the company to stop selling similar defective units until an investigation is conducted.
  • Awarding compensation: The forum orders the company to provide a full refund and pay compensation for the consumer's inconvenience.
  • Imposing a penalty: The forum imposes a fine on the company for misleading the consumer and not fulfilling the warranty terms.

Conclusion

Consumer forums hold significant powers during hearings to ensure justice and protect consumer rights. They can pass binding judgments, investigate complaints, summon witnesses, award compensation, and enforce compliance with their orders. The Consumer Protection Act empowers these forums to act as an essential mechanism for safeguarding consumers and holding service providers accountable.
