Copyright Protection for Online Content in India Indian copyright law protects online content under the Copyright Act, 1957, covering digital works like videos, blogs, music, e-books, software, and websites. 1. What Online Content is Protected? The following types of digital content are protected under Section 13 of the Copyright Act: Text (articles, blogs, e-books) Videos & Films (YouTube, OTT content) Music & Sound Recordings Software & Mobile Apps Graphics, Images, and Photographs Websites & Databases 2. How Copyright Protection Works Automatic Protection: Copyright is granted automatically upon creation, without registration. Exclusive Rights: The creator gets exclusive rights to reproduce, distribute, perform, and monetize the content. Duration: For literary, musical, and artistic works – lifetime of the author + 60 years. For cinematographic films, sound recordings, and software – 60 years from publication. 3. Protection Against Online Infringement Digital Piracy Laws: Sections 51 & 63 of the Copyright Act penalize unauthorized reproduction or distribution. Blocking of Websites: Under Section 69A of the IT Act, the government can block infringing websites. DMCA Takedown: Platforms like YouTube and Facebook follow the Digital Millennium Copyright Act (DMCA) for takedown requests. Court Injunctions: Copyright owners can seek injunctions and damages for infringement. 4. Remedies for Online Copyright Violations Cease & Desist Notice: Send a legal notice to the infringer. DMCA Takedown Request: File a complaint on platforms like YouTube or Google. Legal Action: Civil Suit: Claim damages and seek an injunction under Section 55. Criminal Action: Infringement is punishable with up to 3 years imprisonment and a fine under Section 63. 5. Fair Use & Exceptions Fair Use (Section 52): Allows limited use for education, research, news reporting, and criticism. No Protection for Ideas: Copyright protects only expression, not ideas or concepts.
