What Are The Different Types Of Trademarks In India?

Answer By law4u team

In India, trademarks serve as crucial identifiers for products and services, helping businesses distinguish themselves in the marketplace. The Indian legal system recognizes various types of trademarks, each offering different forms of protection and having specific uses. Understanding the different categories of trademarks can help businesses protect their intellectual property more effectively.

Types of Trademarks in India:

Word Mark:

A word mark is a trademark that consists of letters, words, numbers, or any combination of these. It is used to protect the unique name of a product or service, such as Nike or Coca-Cola.

Device Mark (Logo Mark):

A device mark refers to a logo or symbol used to represent a brand, business, or product. This type of trademark protects visual representations, such as logos or images, that distinguish a product or service.

Service Mark:

A service mark is similar to a trademark but is used to distinguish services rather than products. For example, the mark FedEx identifies the delivery service, and McDonald's identifies the fast-food service.

Collective Mark:

A collective mark is used by a group or association of businesses or individuals to indicate a shared characteristic or quality. For example, the Good Housekeeping Seal is a collective mark that signifies quality for products approved by the Good Housekeeping Institute.

Certification Mark:

A certification mark is used to indicate that the goods or services meet certain standards or certifications set by the owner of the mark. It is often used for products like organic food, fair trade goods, or quality certifications, e.g., ISO 9001 certification.

Geographical Indication (GI):

A geographical indication is a sign that identifies a product as originating from a specific geographical location, where a given quality, reputation, or other characteristic of the product is attributable to its origin. Examples in India include Darjeeling Tea or Kanchipuram Silk.

Sound Mark:

A sound mark protects sounds that are capable of distinguishing a product or service, such as the sound of an opening can for Coca-Cola or the Nokia ringtone.

Shape Mark:

A shape mark refers to a trademark that protects the shape or configuration of a product or its packaging. For example, the distinct shape of a Coca-Cola bottle or the shape of Toblerone chocolate bar.

Legal Actions and Protections:

Trademark Registration:

Each type of trademark can be registered with the Indian Trademark Office to gain legal protection. Registration provides the right to exclusive use of the mark and legal recourse in case of infringement.

Infringement Protection:

If a trademark is infringed upon, the owner can seek legal action through the courts, including injunctions and damages.

Example:

Word Mark Example: The word eliance is a registered trademark for various products and services provided by the Reliance group.

Device Mark Example: The logo of Apple, with its distinctive bitten apple design, is a registered device mark.

Service Mark Example: Air India is a service mark for the airline services it offers.
