1. Check the Return/Refund Policy

Before initiating a complaint, review the seller’s return and refund policy. Most online platforms offer a window (usually 7-30 days) during which defective products can be returned or exchanged. Policies may differ depending on the platform (Amazon, Flipkart, etc.) and the seller, but generally, there should be a clear process for returning defective items.

  • Return period: Ensure that the product is within the return window.
  • Condition of the product: The product should generally be unused or in original condition, unless the defect occurred during shipping or manufacture.

2. Contact the Seller or Online Platform Customer Support

If the digital gadget is defective, the first step is to contact the seller or customer support of the e-commerce platform where the product was purchased. Here’s what you should do:

  • Provide details: Share details of the defective product, including order number, product model, and nature of the defect.
  • Photographic evidence: Upload clear pictures or videos of the defect or the issue (e.g., screen malfunction, missing parts, software issues) to support your claim.
  • Describe the issue: Clearly describe the problem, whether it’s a hardware failure, performance issues, or something else.
  • Request for action: Specify what you are expecting, whether it’s a refund, replacement, or repair.

3. Escalate to Higher Authorities if No Resolution

If customer support is unresponsive or refuses to resolve the issue within the given timeline, escalate the matter:

  • Escalate within the platform: Many e-commerce platforms have an escalation procedure that allows you to report unresolved issues to higher authorities (e.g., a supervisor or grievance officer).
  • File a complaint with the Consumer Forum: If the issue remains unresolved, you can proceed to file a complaint in consumer forums or the Consumer Protection Council.

4. File a Complaint with Consumer Forum

If the e-commerce platform or seller refuses to address the issue satisfactorily, you have the right to file a formal complaint in a consumer court or with the National Consumer Helpline. Here’s how you can go about it:

  • District Consumer Forum: If the product’s value is less than ₹20 lakh, the complaint can be filed with the District Consumer Forum.
  • State Consumer Forum: For claims between ₹20 lakh and ₹1 crore, the complaint is filed with the State Consumer Forum.
  • National Consumer Forum: If the amount exceeds ₹1 crore, the complaint can be escalated to the National Consumer Forum.

When filing the complaint, make sure to include the following documents:

  • Product invoice: Proof of purchase (invoice, payment receipt).
  • Photographs/videos of the defect: Evidence of the defective product.
  • Correspondence with seller/customer support: Copies of emails, chat logs, or other communication showing attempts to resolve the issue.
  • Return/Refund policy: A copy of the return policy as per the platform’s terms and conditions.

5. Time Limit for Filing Complaints

According to the Consumer Protection Act, 2019, complaints must generally be filed within two years from the date of the cause of action (i.e., from when the product was received or the defect was discovered). If the defect was discovered after a few days of use, the consumer still has the right to claim a refund or replacement under warranty.

6. Resolution Options and Remedies

Once the complaint is filed, the consumer court will take action and decide whether the seller should:

  • Refund the full purchase amount.
  • Replace the defective product with a new one.
  • Repair the product or fix the defect.
  • Pay compensation for the inconvenience caused, including any mental distress or expenses incurred.

7. Legal Protection under the Consumer Protection Act

The Consumer Protection Act, 2019 offers legal protection for consumers against defective products. Under the Act, consumers have the right to:

  • Claim replacement or repair of defective products within the warranty period.
  • File complaints for defects that affect the product’s functionality.
  • Seek compensation for faulty products that cause harm, loss, or damages.

Suppose a consumer buys a smartphone online from an e-commerce platform. After receiving it, the device shows several signs of malfunction, such as a non-working camera and poor battery performance.

Steps the consumer should take:

  • Contact Customer Support: The consumer contacts the platform’s customer support, shares the issue, and submits evidence (pictures and videos of the defect).
  • Request for Refund/Replacement: The consumer requests a replacement or a refund within the platform’s return period (14 days).
  • Escalate the Issue: If the seller refuses to honor the claim, the consumer escalates the issue to the Consumer Forum for further action.
  • File a Formal Complaint: The consumer files a formal complaint with the District Consumer Forum, submitting all relevant documents and seeking a full refund or a replacement.
  • Court Resolution: The court hears the case and orders the seller to refund the amount or provide a replacement phone.
