Yes, consumers can approach consumer courts for complaints related to poor customer service. Steps to Approach Consumer Courts for Poor Customer Service

  • Contact the Service Provider First
    Before filing a complaint in consumer court, it’s recommended that the consumer try to resolve the issue directly with the company. Many companies have a grievance redressal mechanism, and issues may be solved through this. Keep a record of all communications (emails, phone calls, letters) with the company, as they will be useful in proving your case.
  • Document the Issue

What Happens After Filing a Complaint?

  • Examination of the Complaint
    Once the complaint is filed, the consumer forum will review the case and may ask for further documentation or clarification.
  • Notice to the Opposite Party
    If the complaint is accepted, a notice will be sent to the service provider asking for their response. They will have a specific time frame to present their side of the case.
  • Hearing and Resolution
    A hearing will be scheduled, during which both parties will present their case. The forum may attempt mediation or pass a judgment based on the evidence.

Possible Outcomes

  • Compensation: The consumer may be awarded compensation for the loss suffered due to poor service.
  • Service Fulfillment: The company may be ordered to fulfill the promised service or correct deficiencies.
  • Refund: In some cases, the consumer may be entitled to a full or partial refund.
  • Penalty on the Service Provider: The forum may impose a fine or penalty on the service provider for failing to adhere to consumer rights or engaging in unfair practices.

Example

Suppose a consumer subscribes to a broadband internet service, and over several months, the internet connection remains unstable, despite multiple complaints. The service provider fails to take corrective action, and the consumer’s repeated requests are ignored.

Steps the consumer should take:

  • Contact the customer service department to resolve the issue and document all communication (emails, call logs, etc.).
  • If the issue is unresolved, file a complaint with the District Consumer Forum providing:
    • The subscription details and the amount paid for the service.
    • Evidence of the complaints and failures of the service provider to address the issue.
  • If the consumer forum rules in the consumer’s favor, they may order the service provider to pay compensation for the loss and failure to deliver the service as promised. The company could also be directed to fulfill the contract by restoring a stable internet connection or refunding the amount paid.
