The National Consumer Disputes Redressal Commission (NCDRC), commonly known as the National Consumer Commission, is the apex body in India for handling consumer disputes at the national level. It is a part of the Consumer Protection Act, 2019, and has significant jurisdiction and powers to adjudicate on complaints related to consumer rights. The Commission has the authority to hear appeals against decisions made by the State Consumer Disputes Redressal Commissions and to handle consumer disputes where the value of the goods or services exceeds a certain monetary threshold.

Jurisdiction of the National Consumer Commission

  • Jurisdiction Over Appeals
    The National Consumer Commission has appellate jurisdiction, meaning it can hear and adjudicate appeals filed against the decisions made by the State Consumer Disputes Redressal Commissions. It acts as the final authority for most consumer complaints in India.
  • Monetary Jurisdiction
    As per the Consumer Protection Act, 2019, the National Consumer Commission has jurisdiction over complaints where the value of the goods or services (including compensation claimed) exceeds ₹1 crore. Complaints involving amounts less than this threshold are handled by State Commissions or District Forums.
  • Original Jurisdiction
    While the primary responsibility of the NCDRC is to hear appeals, it also has original jurisdiction over complaints where the value of goods or services exceeds ₹1 crore. In such cases, consumers can file their complaints directly with the National Commission without going through the lower forums.
  • Power to Grant Relief and Compensation
    The National Consumer Commission has the power to order a wide range of reliefs, including compensation for loss or damage, replacement of goods, refund of price, removal of deficiencies in services, and penalizing the opposite party for unfair trade practices.
  • Power to Issue Directions
    It can issue directions to the opposite parties to stop unfair trade practices and prevent the recurrence of violations. The Commission has the authority to impose fines, and its orders are legally binding.
  • Jurisdiction in Matters of Deficiency in Services or Defective Goods
    The National Commission adjudicates cases related to defective goods and deficient services, as well as complaints related to unfair trade practices and deceptive advertisements.

Scope of Appeals and Remedies

  • Appeal Against State Commissions
    Any party dissatisfied with a decision made by the State Commission can appeal to the National Consumer Commission. These appeals are heard by a bench consisting of members appointed by the Government.
  • Supreme Court as the Last Resort
    If a party is dissatisfied with the verdict of the National Consumer Commission, they can approach the Supreme Court of India, making it the highest appellate authority in consumer disputes.
  • Consumer Protection in E-Commerce
    The National Consumer Commission has also begun addressing disputes related to online transactions, which include issues such as unfair pricing, defective goods, delayed deliveries, or misleading advertising by e-commerce platforms.

  • Consumer Protection Act, 2019
    The jurisdiction and powers of the National Consumer Commission are granted and defined under the Consumer Protection Act, 2019. This Act ensures that consumer grievances are resolved effectively and promptly, providing legal protection to consumers across India.
  • Filing Complaints
    Complaints can be filed online or offline, and the National Commission usually resolves cases within a set time frame. Consumers must provide evidence to support their claim, and all complaints should be filed with the proper jurisdictional authority (based on the value of the complaint).

Suppose a consumer bought a high-end laptop worth ₹1.5 lakh from an online store. After a month, the laptop started showing major technical issues, and the consumer reached out to the company for a replacement, but the company failed to respond.

Steps the consumer should take:

  • First, approach the State Consumer Commission with the complaint as the laptop value is under ₹1 crore.
  • If the State Commission’s decision is unsatisfactory, the consumer can file an appeal with the National Consumer Commission.
  • The National Commission will hear the case, consider all evidence, and may order compensation or a full refund from the company.
  • If the consumer is not satisfied with the National Commission’s decision, they can appeal to the Supreme Court.
