How to file complaints against defective furniture?

Answer By law4u team

Furniture is considered a consumer product under the Consumer Protection Act, 2019. Whether you purchase furniture online or from a physical store, you are entitled to receive products that are free from manufacturing defects, damage, or mismatch. If you receive defective, broken, low-quality, or wrongly delivered furniture, you have the right to file a formal complaint and seek a refund, replacement, repair, or compensation. This applies to both customized and ready-made furniture.

Common Defects in Furniture Purchases

  • Visible physical damage (cracks, dents, scratches)
  • Broken parts or missing components
  • Poor quality material not matching the description
  • Incorrect dimensions or color
  • Delivery of the wrong product
  • Manufacturing defects like uneven alignment, imbalance, or joint problems
  • Fungus, termite infection, or weak structure

Step-by-Step Procedure to File Complaint Against Defective Furniture

  1. Document the Defect Immediately
    • Take clear photos or videos of the damaged or defective furniture.
    • Keep the invoice, warranty card, delivery receipt, and order details.
  2. Contact the Seller or Manufacturer
    • Inform the seller (retail shop, e-commerce platform, or carpenter) about the defect.
    • Share visual evidence and demand a refund, repair, or replacement.
    • Ask for a written or email confirmation of their response.
  3. Check the Return/Repair Policy
    • For online purchases (e.g., Pepperfry, Urban Ladder, Amazon), check if the product is returnable or covered under warranty.
    • Raise a return request within the specified timeline (usually 7–10 days).
  4. Send a Legal Notice (If No Resolution)
    • If the seller does not respond or denies your claim without justification, send a legal notice through a lawyer.
    • Mention the issue, your demand, evidence, and a reasonable deadline (usually 15 days) for resolution.
  5. File a Complaint in the Consumer Forum
    • If the seller or platform fails to resolve the issue even after a legal notice:
    • Prepare a formal complaint with all evidence and documents.
    • File the complaint in the appropriate Consumer Disputes Redressal Commission:
      • District Commission: Claims up to ₹1 crore
      • State Commission: ₹1 crore to ₹10 crore
      • National Commission: Above ₹10 crore
    • You can also file online via E-Daakhil Portal.

Legal Remedies Available

  • Full refund of the purchase price
  • Replacement of the defective furniture
  • Repair of the product at no cost
  • Compensation for inconvenience, mental agony, and additional expenses
  • Penalty on the seller for unfair trade practice
  • Reimbursement of litigation costs

Required Documents

  • Invoice or bill of the furniture
  • Delivery or shipping proof
  • Photos or videos of the defect or damage
  • Email or written correspondence with seller/manufacturer
  • Copy of legal notice (if sent)
  • Medical bills or property damage bills (if applicable)

Tips for Strong Complaint

  • Always inspect furniture at the time of delivery
  • Do not accept packages with visible damage
  • File the complaint within 2 years from the date of issue
  • Retain all purchase and communication records
  • Mention specific defects clearly in your complaint
  • Seek expert valuation if high-value custom furniture is involved

Example

A consumer purchases a ₹40,000 wooden wardrobe from an online retailer. Upon delivery, the wardrobe has deep scratches, the door does not close properly, and shelves are misaligned. The consumer contacts the seller and shares images, but the seller refuses replacement, claiming it is minor wear and tear. The consumer sends a legal notice and then files a case in the District Consumer Forum. The forum orders a full refund along with ₹10,000 as compensation for mental distress and ₹2,000 as legal cost reimbursement.
