What are the powers of Consumer Forums under the Consumer Protection Act?

The Consumer Protection Act, 2019 establishes a three-tier redressal mechanism to resolve consumer disputes quickly and fairly. This includes the District Consumer Disputes Redressal Commission, State Commission, and National Commission. Powers of Consumer Forums under the Consumer Protection Act, 2019

1. Adjudication of Consumer Disputes

  • Hear complaints regarding defective goods, deficiency in services, unfair trade practices, overcharging, misleading ads, etc.
  • Examine witnesses, collect evidence, and deliver judgments similar to civil courts.

2. Power to Grant Compensation

  • Direct manufacturers or service providers to pay compensation for losses, damages, or mental agony suffered by the consumer.
  • Award punitive damages in case of gross negligence or willful misconduct.

3. Orders for Replacement, Refund, or Repair

  • Order the seller to replace defective goods.
  • Refund the paid amount.
  • Repair the product at no additional cost.

4. Product Recall and Withdrawal from Market

  • Order recall of unsafe or hazardous products from the market.
  • Direct the discontinuation of unfair or misleading advertisements.

5. Enforcement of Orders

  • If a party fails to comply with the forum’s order:
    • The forum can initiate enforcement proceedings, including attachment of property.
    • Failure to comply can result in imprisonment up to 3 years or fines up to ₹1 lakh, or both.

6. Power to Issue Interim Orders

  • Issue interim injunctions to prevent further harm or losses during proceedings.
  • Restrain companies from selling defective products or continuing harmful practices.

7. Review and Appeal

  • Forums can review their own orders if errors are discovered.
  • Parties can appeal decisions to higher forums within a stipulated time frame.

8. Jurisdictional Powers Based on Value

  • District Commission: Up to ₹50 lakh
  • State Commission: ₹50 lakh to ₹2 crore
  • National Commission: Above ₹2 crore

This ensures that consumers of all economic levels have access to justice.
