What If Abuse Continues After Restraining Order?

Answer By law4u team

Restraining orders are crucial legal tools to protect domestic violence survivors from further abuse or harassment by the abuser. However, in some cases, the abuser may disregard the court’s order and continue abusive behavior. Indian law provides mechanisms to enforce these orders and penalize violators to ensure the safety and dignity of survivors.

Legal Remedies and Enforcement When Abuse Continues

Reporting Violation of Restraining Order

Survivors should immediately report any breach of the restraining order to the police or Protection Officer.

Under Section 31 of the Protection of Women from Domestic Violence Act (PWDVA), violating a protection or restraining order is punishable by law.

Police Action and Investigation

Police are mandated to act promptly upon receiving complaints of violation and can arrest the abuser if necessary.

They must file a First Information Report (FIR) and initiate investigation into the violation.

Contempt of Court Proceedings

Continued violation may lead to contempt of court charges against the abuser.

Courts can impose fines, imprisonment, or other penalties to enforce compliance.

Modification or Extension of Protection Orders

Survivors can approach the court to extend, modify, or strengthen the protection order if abuse persists.

Courts may include additional safeguards such as police protection, banning contact, or exclusion from the shared household.

Criminal Complaints

Abusers may also face criminal charges under IPC sections such as criminal intimidation, assault, or stalking.

This ensures a stricter legal consequence alongside civil protection.

Support Services

Protection Officers, NGOs, and legal aid services can assist survivors in enforcing orders and accessing shelters or counseling.

Practical Tips for Survivors

Keep detailed records of each violation, including dates, times, and witnesses.

Maintain copies of all court orders and police reports.

Inform the Protection Officer and court immediately if the abuse continues.

Use helpline numbers and women’s protection cells for quick assistance.

Example

A survivor has a restraining order against her abusive spouse, but he repeatedly sends threatening messages and tries to approach her home.

Steps Taken:

The survivor reports the violations to the local police and Protection Officer with evidence of messages.

Police file an FIR against the abuser for violating the court order.

The court initiates contempt proceedings and may order the abuser’s arrest.

The survivor requests the court to strengthen the protection order by including police monitoring and restricting all contact.

The abuser is legally restrained and faces penalties for non-compliance, ensuring the survivor’s safety.
