What If A Spouse Refuses To Disclose Income During Interim Hearing?

In interim maintenance proceedings, income disclosure is a critical factor in determining the amount of support to be granted. If a spouse refuses to disclose their income, it can hinder the court’s ability to arrive at a fair judgment. To protect the interests of the financially dependent party, the law provides mechanisms to deal with such non-cooperation.

Legal Consequences of Refusing Income Disclosure

1. Mandatory Disclosure Requirement

Courts require both parties to file detailed financial affidavits, as laid down in various judgments (e.g., Rajnesh v. Neha, 2020 SC ruling). These include income, assets, liabilities, lifestyle, and expenses.

2. Court May Draw Adverse Inference

If a party fails or refuses to disclose income, the court can draw an adverse inference—i.e., assume that the person is earning more than they claim or is trying to suppress facts.
This may lead to higher maintenance being granted in favor of the other party.

3. Use of Indirect Evidence

Courts may rely on indirect evidence such as:

Bank statements

Lifestyle indicators (car, property, foreign travel, etc.)

Employer information, social media activity

Income tax returns (if available)

4. Court Directions and Orders

The court may pass specific orders compelling disclosure within a timeframe. Continued non-compliance can lead to:

Striking off the defense of the non-cooperating party

Contempt of court proceedings

Imposing costs or fines

5. Equal Responsibility to Disclose

Both the applicant and the respondent must disclose their financials. A party seeking maintenance must also prove need and lack of income. Non-disclosure by either side weakens their claim or defense.

6. Impact on Final Orders

The conduct during interim proceedings—such as deliberate concealment—can influence the court's view during final maintenance or divorce judgments, possibly affecting alimony, custody, and property division.

Scenario:
A wife files for interim maintenance under Section 125 CrPC. The husband refuses to file his income affidavit, claiming he is unemployed, but the wife submits photos of his luxury car and screenshots of recent foreign trips from social media.

Steps Taken by Court:

The court orders the husband to submit a full financial disclosure within 15 days.

Upon failure to comply, the court draws an adverse inference and assumes he has substantial income.

The court grants ₹25,000 per month as interim maintenance based on lifestyle indicators.

Simultaneously, the court warns the husband of possible contempt proceedings if he continues to disobey.
