Can A Wife Receive Maintenance Without Producing Proof Of Marriage?

Answer By law4u team

In India, maintenance claims by a wife under Section 125 of the CrPC or personal laws generally presuppose the existence of a valid marriage. However, courts recognize that documentary proof of marriage may not always be available, especially in informal or customary unions. In such cases, courts rely on other evidence and principles like presumption of marriage and conduct of parties to decide maintenance eligibility.

Maintenance Without Documentary Proof of Marriage

Presumption of Marriage

Courts may presume marriage if parties have lived together as husband and wife, publicly acknowledged the relationship, and performed customary ceremonies or rituals, even if no formal marriage certificate exists.

Cohabitation and Domestic Relationship

Continuous cohabitation in a conjugal relationship can be evidence of marriage or a marriage-like relationship warranting maintenance.

Judicial Precedents

Several rulings by the Supreme Court and High Courts allow maintenance claims based on valid relationship despite lack of formal proof, especially where the woman faces hardship.

Burden of Proof

The claimant must prove existence of a marital or marriage-like relationship by evidence such as witness testimony, photographs, joint documents, or acknowledgment by the other party.

Legal Recognition of Unregistered Marriages

Personal laws and courts have accepted unregistered marriages, customary marriages, or even long-term live-in relationships for maintenance claims, subject to proof.

Exceptions and Limitations

Maintenance is not granted in purely casual relationships or where parties deny the existence of any marital tie with convincing evidence.

Relevant Legal Provisions

Section 125 CrPC focuses on maintenance to wives, irrespective of registration status.

Hindu Marriage Act recognizes customary and unregistered marriages.

Protection of Women from Domestic Violence Act, 2005 also protects women in domestic relationships.

Practical Advice

Collect and present all possible evidence of relationship and cohabitation.

Obtain affidavits from family members or community elders supporting the marriage claim.

Engage legal counsel to present a strong case based on circumstantial and testimonial evidence.

Example

Suppose a woman lives with a man for several years, they hold a customary ceremony, and she acts as his wife socially, but no marriage certificate exists.

Steps:

She files a maintenance application under Section 125 CrPC.

Provides witnesses who testify to the marriage-like relationship and cohabitation.

Submits photographs, letters, or joint accounts showing shared life.

Court may accept this as proof of marriage and grant maintenance accordingly.

If the man denies the relationship, the court weighs the evidence and decides.
