What Is a Red Corner Notice?

Answer By law4u team

A Red Corner Notice (RCN) is an international alert issued by Interpol to notify its 195 member countries about a person wanted by judicial authorities for prosecution or to serve a sentence. It serves as a request to locate, identify, and provisionally arrest the individual pending formal extradition or legal action. Although it is not an arrest warrant itself, it acts as a vital tool for international police cooperation and criminal justice.

Detailed Explanation

Purpose and Function

The RCN is primarily a request for assistance in the identification and temporary detention of individuals wanted for serious crimes such as murder, terrorism, fraud, or human trafficking.

It facilitates cross-border law enforcement efforts by alerting all member countries about the fugitive’s identity, physical description, and criminal charges.

Difference from an Arrest Warrant

Unlike an arrest warrant issued by a court within a particular country, a Red Corner Notice is an international alert and does not have legal force to compel arrest.

Each country uses its own laws to decide how to act on the notice—some treat it as a basis for arrest, others may use it for intelligence or border control.

Information Included in a Red Corner Notice

Details such as the fugitive’s name, photograph, physical characteristics, nationality, alleged offenses, and the requesting country’s contact details are included.

This information helps law enforcement agencies worldwide recognize and locate the individual.

Issuance Process

A member country’s authorized judicial or law enforcement agency requests Interpol to issue an RCN through the National Central Bureau (NCB).

Interpol reviews the request to ensure it complies with its rules, especially regarding human rights and political neutrality.

Role in Extradition and Provisional Arrest

The RCN often precedes or accompanies formal extradition requests. It enables the requested country to arrest the fugitive provisionally and then initiate the extradition process.

It also acts as an early warning system for border control agencies to prevent fugitives from crossing borders unnoticed.

Limitations and Safeguards

Interpol excludes requests motivated by political, military, racial, or religious reasons.

The RCN does not guarantee arrest or extradition; it is a tool for cooperation, subject to national laws and judicial procedures.

Example

Country Y issues a Red Corner Notice for an individual accused of large-scale corruption. Interpol circulates the notice to all member countries. Indian police recognize the person during a routine check at an airport and detain him provisionally. Subsequently, India receives and processes the formal extradition request from Country Y based on this notice.
