Can court marriage be performed online or remotely in India?

Dear Client, Indian Laws governing court marriages mentions physical presence of the couples who are getting registered as couple via court marriage, and couples along with the witness is require to show their presence and sign the valid documents to register as partners via court marriages. And verification process of the age and other documents in the presence of the registrar is mandatory. Nevertheless, at the time of COVID-19 Pandemic, Online Court Marriages were taking place at some places, at the time when all the things were running online a few states allowed the registration Online and the presence of couples along with witness where to be done online mode and a remote method were also appreciated at that time. And registrar also used to participate and perform their duty and responsibility virtually. At present and as of now online court marriage and remote method of court marriage can be done only if local authority and registration office is permitting this, and the state can officially publish a guidelines and policy which needs to be followed by the said authority. Hence a state can allow this in some places by notice. I hope this answer helps.

Dear Client, In India the laws clearly says that court marriages require physical presence of the couples who want to get registered under the Court Marriage, and both the parties along with the witness should show their presence and sign the documents required to register as a couple via court marriages. And process of verification of the age and other certificates in the presence of the registrar is a must and one of the requirements. But, however, during the COVID-19 Pandemic when almost all the things were running online, certain courts allowed the registration Online in which process which was performed in presence where to be done via online mode and a remote method were also allowed at that time. And registrar used to participate virtually and conduct the court marriage process. And right now, this online and remote method of court marriage can be performed if local authority and registration office is allowing this, and the state can publish a guidelines and policy which needs to be followed for this. So, it depends on state to state and also one city to another and at some rare emergency case the court may allow it if there is no other option but local authority decides it.
