Dear Client, An individual violating a restraining order, also known as a Protection Order, Residence Order, or Interim Order, issued under the Protection of Women from Domestic Violence Act, 2005, commits a criminal offence. Here are the consequences of such violation – 1. The individual can face punishment under Section 31 of the Domestic Violence Act, of up to 1 year of imprisonment, or a fine up to ₹20,000, or both. 2. This violation is also treated as the wilful disobedience of a lawful order of a Court, and is therefore punishable under Section 356 of Bharatiya Nyaya Sanhita, 2023, with imprisonment and/or fine. 3. This violation is treated as a cognizable and non-bailable offence, and therefore the police can arrest an individual committing the same without an arrest warrant. 4. After such violation, the court may impose even stricter restrictions on the individual and even cancel bail if already granted. I hope this answer helps.
