In India, drivers involved in a motor accident have certain legal obligations to provide assistance to the injured parties and report the accident to the authorities. These obligations are outlined in various laws and regulations, including the Motor Vehicles Act, 1988, and the Indian Penal Code. Here are the key legal obligations for drivers after a motor accident: Stop and Provide Assistance: The driver of any vehicle involved in an accident is required to stop their vehicle immediately at the scene of the accident and provide assistance to any injured persons. This assistance may include arranging for medical help and transporting the injured to the nearest medical facility, if necessary. Inform Authorities: The driver must report the accident to the nearest police station as soon as possible, preferably within 24 hours of the accident, especially if there are injuries or fatalities involved. Failure to report an accident to the police may result in legal consequences, including penalties or criminal charges. Exchange Information: Drivers involved in an accident must exchange relevant information with each other, including their names, addresses, vehicle registration numbers, insurance details, and contact information. This information is essential for insurance claims and legal proceedings related to the accident. Cooperate with Authorities: Drivers are obligated to cooperate with the police and other authorities investigating the accident. This includes providing statements, participating in investigations, and complying with any legal requirements or procedures related to the accident. Assist Injured Persons: Drivers have a duty to provide reasonable assistance to any injured persons at the scene of the accident. This may involve administering first aid, calling emergency services, or arranging for transportation to a medical facility. Preserve the Scene: Drivers should take steps to preserve the scene of the accident to the extent possible. This may include taking photographs, securing the area, and avoiding tampering with evidence until the police arrive and complete their investigation. Provide Information to Authorities: Drivers involved in an accident may be required to provide additional information or documentation to the police or other authorities investigating the incident. This may include providing statements, providing access to vehicle documents, or participating in vehicle inspections or tests, if necessary. Failure to fulfill these legal obligations after a motor accident can result in legal consequences, including fines, penalties, license suspension, or even criminal charges, depending on the severity of the offense and the circumstances of the accident. It's essential for drivers to be aware of their obligations and take prompt and responsible action in the event of an accident to ensure the safety and well-being of all parties involved.

Dear Client, In India, motor accidents are governed by the Motor Vehicles Act, 1988, and Section 166 of this Act states the provision for claiming compensation for emotional distress in such accidents. In motor accident cases, the compensation for emotional distress can be claimed before the Motor Accident Claims Tribunal (MACT) for various reasons like – mental suffering, trauma, and loss of enjoyment of life as part of damages. For this, you must be able to show evidence of some actual harm, may it be psychological or emotional. Such harm in motor accident cases is generally connected to the victim suffering some physical injury as well. I hope this answer helps. For any further queries, please do not hesitate to contact us.
