Under Indian law, the marriage between a Muslim woman and a non-Muslim man depends entirely on the legal framework chosen for the solemnization of the marriage, as personal laws and secular laws approach this situation differently. According to traditional Islamic jurisprudence governed by Muslim Personal Law applicable in India, a Muslim woman is strictly prohibited from marrying a man who is not a Muslim, unless the man first converts to Islam. Under classical Sunni law, such a marriage is considered irregular or fasid, and under Shia law, it is considered void or batil. Therefore, if the couple wishes to marry according to traditional religious rites under Muslim personal law, the non-Muslim partner must formally convert to Islam and embrace the faith before the marriage can take place. However, India provides a secular alternative that completely bypasses religious restrictions through the Special Marriage Act, 1954 (SMA). The Special Marriage Act applies to all citizens of India regardless of their religion, caste, or creed. Under the provisions of the Special Marriage Act, 1954, a Muslim woman can legally marry a non-Muslim man without either party needing to renounce their religion, convert to Islam, or change their faith. To marry under the Special Marriage Act, 1954, the couple must fulfill certain statutory conditions. Both parties must have attained the legal age of marriage, which is 21 years for the male and 18 years for the female. Both parties must be capable of giving a valid consent and must not have a living spouse at the time of the marriage. Furthermore, they must not fall within the degrees of prohibited relationship as specified under the Special Marriage Act, 1954. The procedure for solemnizing a marriage under the Special Marriage Act, 1954, requires the couple to give a formal notice of intended marriage to the Marriage Officer of the district in which at least one of the parties has resided for not less than thirty days immediately preceding the date on which such notice is given. Upon receiving this notice, the Marriage Officer publishes it by affixing a copy to some conspicuous place in their office. Any person can raise objections to the marriage within thirty days from the date of publication of the notice, provided the objection is based on legal grounds such as violation of the age requirement, existing undissolved marriage, or prohibited degrees of relationship. If no valid objections are raised within the statutory thirty-day period, the marriage may be solemnized after the expiration of that period in the presence of the Marriage Officer and three witnesses. It is also important to consider the legal consequences that follow a marriage solemnized under the Special Marriage Act, 1954, particularly regarding inheritance and succession. When a Muslim woman marries a non-Muslim man under the Special Marriage Act, 1954, the marriage is governed by the provisions of the Special Marriage Act, 1954, rather than Muslim Personal Law. Consequently, the succession to the property of persons married under the Special Marriage Act, 1954, is governed by the Indian Succession Act, 1925, instead of Muslim personal law rules of inheritance. Furthermore, if both parties belong to undivided Hindu, Buddhist, Sikh, or Jaina families, marrying under the Special Marriage Act, 1954, results in severance from the joint family, though this specific consequence does not apply in the same manner to Muslim participants, whose property rights and succession are instead routed directly through the Indian Succession Act, 1925. In summary, a Muslim woman cannot marry a non-Muslim man under traditional Muslim personal law unless the man converts to Islam. Nevertheless, Indian law completely upholds the right of consenting adults of different faiths to marry through a civil ceremony under the Special Marriage Act, 1954, making religious conversion entirely optional if they choose the secular legal route.
