What are the rights of an accused during anticipatory bail hearing?

During an anticipatory bail hearing, an accused has several legal and constitutional rights to ensure a fair process under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The accused has the right to: Apply for anticipatory bail before the Sessions Court or the High Court if they reasonably apprehend arrest for a non-bailable offence. Be represented by an advocate of their choice. Present facts, documents, and legal arguments in support of the bail application. Request interim protection from arrest, where appropriate, until the final disposal of the application. Receive a fair and impartial hearing before the court. Respond to the objections raised by the Public Prosecutor or the police. Rely on documents, previous court orders, medical records, or any other material relevant to the case. Seek a reasoned order from the court if the application is allowed or rejected. During the hearing, the court generally considers: The nature and gravity of the alleged offence. The applicant's role in the offence. Whether custodial interrogation is necessary. The possibility of the applicant absconding. The likelihood of tampering with evidence or influencing witnesses. The applicant's criminal antecedents, if any. The applicant's willingness to cooperate with the investigation. If anticipatory bail is granted, the accused has the right to remain protected from arrest in relation to that offence, subject to compliance with the conditions imposed by the court. If the application is rejected: The accused has the right to approach a higher court for anticipatory bail. If arrested, the accused has the right to apply for regular bail before the competent court. The accused also has the following constitutional protections throughout the proceedings: The right to life and personal liberty. The presumption of innocence until proven guilty. The right against self-incrimination. The right to consult and be defended by an advocate. The right to equality before the law and equal protection of the laws. Anticipatory bail is a discretionary remedy. The court balances the accused's right to personal liberty with the need for a fair and effective investigation before deciding whether to grant or refuse relief.
