Human trafficking under international law is the recruitment, transportation, transfer, harbouring, or receipt of persons through unlawful means for the purpose of exploitation. The internationally accepted definition is contained in the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (commonly known as the Palermo Protocol). Human trafficking generally consists of three elements: The Act – Recruiting, transporting, transferring, harbouring, or receiving a person. The Means – Using force, threats, coercion, abduction, fraud, deception, abuse of power, or giving payments or benefits to obtain control over a person. The Purpose – Exploitation. Exploitation may include: Forced labour or services. Sexual exploitation. Slavery or practices similar to slavery. Servitude. Forced marriage, where recognized under applicable law. Removal or trafficking of organs. Child exploitation, including forced begging or illegal adoption, depending on the circumstances. In the case of children, it is not necessary to prove force, coercion, or deception if the child was recruited, transported, transferred, harboured, or received for the purpose of exploitation. International law requires countries to: Criminalize human trafficking. Protect and assist victims. Investigate and prosecute traffickers. Cooperate with other countries in cross-border investigations. Prevent trafficking through awareness, border controls, and law enforcement measures. Human trafficking is different from human smuggling: Human trafficking involves exploitation of the victim. Human smuggling generally involves facilitating the illegal entry of a person into another country, usually with that person's consent, and does not necessarily involve exploitation. In India, human trafficking is a criminal offence under the Bharatiya Nyaya Sanhita, 2023 (BNS). Depending on the facts, other laws such as the Immoral Traffic (Prevention) Act, 1956, the Protection of Children from Sexual Offences Act, 2012 (POCSO), the Bonded Labour System (Abolition) Act, 1976, and the Juvenile Justice (Care and Protection of Children) Act, 2015 may also apply. Victims of human trafficking are entitled to protection, rescue, rehabilitation, and legal assistance. Law enforcement agencies in India also cooperate with foreign authorities through mechanisms such as Mutual Legal Assistance Treaties (MLATs), extradition arrangements, and INTERPOL in cases involving cross-border human trafficking.

The internationally accepted definition is provided under Article 3 of the UN Palermo Protocol (2000), which supplements the United Nations Convention against Transnational Organized Crime (UNTOC). Three Essential Elements - Act: Recruiting, transporting, transferring, harbouring, or receiving a person. - Means: Force, threats, coercion, abduction, fraud, deception, abuse of power, or exploitation of vulnerability. - Purpose: Exploitation, including forced labour, sexual exploitation, slavery, servitude, or organ removal. Position under Indian Law India is a signatory to the Palermo Protocol, and human trafficking is addressed through: - Article 23 of the Constitution of India (prohibits trafficking and forced labour). - Section 143 of the Bharatiya Nyaya Sanhita (BNS), 2023, which specifically criminalizes trafficking of persons and provides stringent punishment depending on the nature of the offence.
