What legal action can be taken against online defamation?

Online defamation in India is treated as a serious offence when false statements are published on social media, websites, emails, or messaging platforms that harm a person’s reputation. 1. Criminal action (FIR and prosecution) A victim can file an FIR under criminal law. Under Bharatiya Nyaya Sanhita, 2023: Defamation (publishing or spreading false statements harming reputation) Criminal intimidation (if threats are involved) False information causing harm or public mischief (in some cases) Punishment can include: Imprisonment up to 2 years (or more depending on aggravating factors under related offences) Fine Or both Police can investigate and file a charge sheet in court. 2. Cyber law provisions If defamation is online, provisions of the IT Act, 2000 may also apply: Section 66A is struck down by the Supreme Court (no longer valid) Section 66D (if impersonation is used) Section 67 (if obscene or harmful digital content is involved) Intermediary Rules for takedown of content Social media platforms can be ordered to remove defamatory content. 3. Civil action (monetary compensation) A victim can also file a civil defamation suit for: Damages for loss of reputation Compensation for mental distress or financial loss Injunction to remove content or prevent further publication Courts can order: Removal of posts or videos Permanent injunction against the offender 4. Interim relief (quick court action) Victims can seek: Temporary injunction to immediately stop circulation of defamatory content Blocking orders against websites or accounts 5. Evidence required Strong proof is important, such as: Screenshots of posts/messages URLs and timestamps Witnesses or digital records Certified electronic evidence (where required) 6. Action through cybercrime portal Victims can also: File complaint on cybercrime.gov.in Request removal of content Report impersonation or fake accounts 7. Important legal principle Defamation must involve: A false statement Published or communicated to others Harm to reputation Truth, fair comment, and public interest are valid defences. 8. Summary Legal action against online defamation in India includes filing FIR, criminal prosecution, civil defamation suit for damages, and requesting takedown of content under cyber laws, along with court injunctions to prevent further harm.
