What is an affidavit and when is it required?

An affidavit is a written statement of facts that is made voluntarily by a person and confirmed by oath or affirmation before an authorized officer such as a notary public or an oath commissioner. The person who makes the affidavit is called the deponent. In India affidavits are used as evidence in courts and legal proceedings under the principles of the Indian Evidence Act, 1872. It serves as a declaration that the contents are true to the best knowledge of the person making it. An affidavit is commonly required in situations such as court cases for presenting facts or documents, property matters, name change or address proof, marriage or birth related declarations, company law compliances, and applications submitted to government authorities where a sworn statement is needed. If a person makes a false affidavit it can lead to legal consequences including punishment for perjury.
