To make a legal agreement in India, there are certain documents and requirements that need to be fulfilled to ensure the agreement is valid, enforceable, and legally binding. Below is a list of common documents and details needed for drafting a legal agreement: 1. Parties' Identification Proofs Individuals: Aadhar Card (for Indian citizens) Passport (if available) Voter ID or Driving License (as an additional identity proof) Companies/Organizations: Certificate of Incorporation Company PAN (Permanent Account Number) Board Resolution (if signing on behalf of the company) These documents are essential to verify the identity and legal status of the parties involved. 2. Address Proof Individuals: Recent utility bills (electricity, water, etc.), bank statements, or Aadhar card with the address. Companies/Organizations: Office address proof (like rental agreement or electricity bill in the name of the company). 3. Witnesses Witnesses' Details: Two or more witnesses are typically required for many types of agreements. You will need their name, address, and signatures. Witness Identification: Similar to the parties, the witnesses may need to provide Aadhar, PAN, or Voter ID as proof of their identity. 4. Agreement Draft A written draft of the agreement should include: Names of the parties (individuals, organizations, or companies) Terms and conditions: Clear, detailed, and specific terms for each party's rights and obligations. Signatures: All parties and witnesses must sign the agreement. The agreement is considered executed when it has been signed and dated. Date and Place: Specify the date and location of signing. 5. Stamp Paper In India, for certain types of agreements (like sale agreements, rental agreements, partnership deeds, etc.), you are required to execute the document on a stamp paper of the required denomination as per state laws. The value of the stamp paper depends on the nature of the agreement and the state in which it is being executed. For example: For agreements related to sale/purchase of property, the stamp duty could vary depending on the property's value. For loan agreements or lease/rental agreements, the stamp duty is based on the terms of the agreement and is generally a fixed amount. 6. Payment Receipts (if applicable) If the agreement involves any exchange of money (like a loan agreement or a purchase contract), receipts or payment confirmations might be required. This includes bank transfer receipts, cheques, or any other payment-related documents. 7. Pan Card of Parties (if applicable) If the transaction involves a significant amount of money (particularly in the case of business agreements or financial transactions), the PAN card of the involved parties may be necessary. It ensures the parties are identifiable for tax and financial records. 8. Specific Agreement Terms/Conditions Documents If the agreement involves special terms, you might need to provide supporting documents to clarify or back up those terms, such as: Property title documents (for sale, lease, or mortgage agreements) Financial statements (in case of a business partnership or loan agreement) Existing contracts or agreements (if modifying or extending an earlier agreement) 9. Notarization (if required) Some agreements may need to be notarized, especially if they involve substantial amounts or are being used in legal disputes. A notary public may need to verify the authenticity of the document by witnessing the signatures of the parties. 10. Additional Documents Based on Agreement Type Depending on the nature of the legal agreement, you may need additional documentation. Here are examples for specific types of agreements: Lease Agreement: Copy of the property documents, rent receipts, and NOC from landlord (if applicable). Partnership Deed: Partnership registration documents, PAN card of the partners, and proof of capital contribution. Employment Contract: Employee’s previous employment proof, educational certificates, and salary slips. Loan Agreement: Loan account statements, collateral documents, and any guarantee documents. 11. Bank Account Details (if applicable) If the agreement involves financial transactions (such as a loan agreement or business contract), the bank account details of the parties involved might be required, especially for payments or deposits. Final Steps to Ensure the Agreement is Legally Enforceable: Signatures: All parties, and in some cases, witnesses, must sign the agreement. Registration: Some agreements (like property-related agreements) may require registration with the Sub-Registrar under the Registration Act, 1908 to become legally enforceable. Preserve Copies: Each party should keep a signed copy of the agreement, and if it is registered, the original registered document should be kept safe.

Dear Client, According to the law, for any document or agreement to be considered valid and effective, your identification documents must be accurate and must be connected. To make sure that a legal agreement is not affected by any administrative or financial issues, you must provide the following: 1. Matching PAN and Aadhaar: You must make sure that there is no name mismatch between your PAN and Aadhaar, as this is one of the main reasons for the failure of the linking process. The Indian government has made all unlinked PAN cards non-functional. 2. Corrected Master Document: You must choose one document (usually Aadhaar) to be considered the "master" document and make sure that the other document is identical to it to avoid any legal inconsistencies. 3. Active PAN Status: To make sure that your PAN is active for all legal and financial transactions, you must have paid the late fee of ₹1,000 through the e-Pay Tax service if the names were matched after the 31st of December 2025. Moreover, you must be aware that any agreement that is reached through fraud, deceit, or misrepresentation is not considered a legal form of consent and can be annulled.
