Dear client, The simple answer to your question is no. Aadhaar is not mandatory for court marriage in India. A court marriage is solemnised under the Special Marriage Act, 1954, which does not prescribe Aadhaar as a compulsory document. It only requires proof of identity, age, marital status, and residence, which may be established through alternative government issued documents such as passport, voter ID, PAN card, or birth certificate. Further, the Supreme Court in Justice K.S. Puttaswamy (Retd.) v. Union of India [(2017) 10 SCC 1] has held that Aadhaar can be made mandatory only where specifically authorised by law, and marriage is not one such notified service. Although some Marriage Officers may request Aadhaar for administrative convenience, such requirement is merely directory and not statutory, and refusal to solemnise or register a marriage solely for non-production of Aadhaar would not be legally sustainable.
