Dear Client, In India, costs to apply for a patent are different for individuals, startups, or SME and large businesses as well as whether the application is submitted online or via an agent. In addition, the fee structure is based on the Patent Rules, 2003, as amended. Here is the official government filing fees for patent applications in India, although these are all approximate figures and not exact ones since the exact fees may vary – 1. For any individuals, start-ups, or small entity businesses – a. Patent application filing fees is between ₹1,600 and ₹1,750. b. Complete specifications if filed provisional: this is included in above listed fees. c. For any extra pages or claims whenever applicable, there is a ₹160 charge per page or claim. d. An early publication request fee is ₹2,500 e. An examination request fee of ₹4,000 is obligatory. 2. For large corporations – a. Patent application filing fees is between ₹8,000 and ₹8,800. b. A request for examination is another ₹20,000. c. Request for an early publication is ₹12,500. d. For any extra pages or claims whenever applicable, there is a ₹400 charge per page or claim. 3. Professional fees charged by advocates, patent agents (depends professional to professional) – a. Provisional specification fees is between ₹10,000 and ₹50,000. b. Complete specification drafting fees is between ₹25,000 and ₹1,00,000, or more. c. Fees for filing, compliance, responses is between ₹10,000 and ₹30,000. Adding all the above, the total estimated cost would be – 1. For individuals, start-ups, etc – between ₹25,000 and ₹1,00,000. 2. For companies, between ₹75,000 and ₹2,00,000, or more.
