India has a legal framework for dealing with extradition requests from other countries. The Indian legal system deals with extradition requests based on the Extradition Act, 1962, which regulates the extradition of fugitive offenders to and from India. Here is how the Indian legal system deals with extradition requests from other countries: Procedure for Extradition Request: A foreign country may initiate the extradition process by making a formal request to the Government of India through diplomatic channels. The request must be supported by relevant documents, such as a warrant for arrest or a court order. Review of Extradition Request: Once the extradition request is received, the Indian government reviews it to determine if it meets the requirements of the Extradition Act, 1962. If the request is found to be valid, it is forwarded to the concerned court for further processing. Court Proceedings: The concerned court reviews the extradition request and determines if there is sufficient evidence to support the charges against the accused person. The court also examines whether the extradition would violate the human rights of the accused person. Appeals and Review: If the court grants extradition, the accused person has the right to appeal the decision to a higher court. Additionally, the government may also review the decision to ensure that it is in line with the provisions of the Extradition Act, 1962. Surrender of Accused Person: If the court grants extradition and all legal procedures are followed, the accused person is surrendered to the requesting country. Overall, the Indian legal system deals with extradition requests from other countries in accordance with the Extradition Act, 1962, and ensures that the extradition process is fair, transparent, and consistent with international law.
