Can the application be rejected? On what grounds?

Yes, a consumer complaint application under the Consumer Protection Act, 2019 can be rejected by the Consumer Commission on certain legal and procedural grounds. Here are the main reasons: 1. Lack of Jurisdiction – If the value of goods/services exceeds the monetary limit of that Commission – If the opposite party’s business or branch is not located within its territorial jurisdiction – If the complaint pertains to a matter outside the scope of consumer law, such as criminal or service matters not covered by the Act 2. Complaint Not Filed by a “Consumer” – If the complainant is not a consumer under the Act (e.g., bought goods for commercial purposes, unless a small self-employed person) – If the complaint is filed by a person without authority or legal standing 3. Delay in Filing (Limitation) – Complaint filed beyond the 2-year limitation period from the date of cause of action – Unless the complainant files an application to condone the delay with valid reasons, and the Commission accepts it 4. Insufficient Cause of Action – If the complaint does not disclose any deficiency in service, unfair trade practice, or product defect – If the complaint appears to be frivolous, vexatious, or malicious 5. Incomplete or Defective Complaint – If the complaint lacks necessary documents, affidavits, or clear allegations – If fees (if applicable in higher forums) are not paid or procedural requirements are not followed 6. Already Decided Matter (Res Judicata) – If the issue has already been decided by the same or another competent authority 7. Abuse of Process of Law – If the complaint is filed with the intent to harass, delay, or gain undue advantage, the forum may dismiss it In case a complaint is rejected, the Commission is required to record the reasons in writing, and the complainant has the right to appeal to a higher forum within the prescribed time.

Dear Client, Yes if an application does not comply with legal requirements it may be denied under any law (such as the Domestic Violence Act RTI or Succession Certificate). For instance if an application is unclear, lacking relates to information exempted by Sections 8 and 9 or violates procedural guidelines it may be denied under the RTI Act. A court may also dismiss a complaint of domestic violence if it lacks jurisdiction, fails to disclose a cause of action containing false allegations or fails to follow the proper procedures.
