How long does it take to get a succession certificate?

Answer By law4u team

The time taken to obtain a succession certificate in India typically varies depending on the complexity of the case and the workload of the court, but generally it takes between 3 to 6 months. Here are some factors affecting the timeline: Filing of Petition: After filing the succession certificate petition in the competent civil court, the court issues notices to all interested parties. Notice Period: The court usually allows a notice period of about 30 days to invite objections from creditors or other heirs. Hearing and Objections: If no objections arise, the court may grant the certificate sooner. If objections are raised, hearings and evidence may prolong the process. Court Backlog: The time also depends on how busy the court is and the efficiency of the judicial process in that jurisdiction. Document Verification: Verification of documents and identity proofs can also affect the duration. Summary: Under normal circumstances, obtaining a succession certificate takes around 3 to 6 months from the date of filing the petition, but delays can occur if objections are raised or if the court’s schedule is congested.

Dear Client, It usually takes 3-6 months to obtain a succession certificate in India, provided the case is not contentious and documents are clear. This begins with the filing of a petition in the district or civil court having jurisdiction over the domicile of the deceased. Once the petition is submitted, the court gives a public notice in a newspaper, calling for objections from the public. The period of notice is usually 30 to 45 days. If objections are not received, the court proceeds with the final hearing and issues the certificate. Yet, if there are quarrels among heirs or objections are presented, then the process may run longer, occasionally even more than a year. Delays also take place because of incomplete documentation or court backlog. I hope this answer helps. In case of future queries, please feel free to contact us. Thank you.
